Welcome to nabsta! These Terms of Service ("Terms") govern your access to and use of the nabsta mobile application, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

We may modify these Terms at any time. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

2. Eligibility

To use nabsta, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

By using nabsta, you represent and warrant that you meet all eligibility requirements.

• Attempt to circumvent any security features
• Scrape, crawl, or use automated means to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Collect or store personal information about other users without consent
• Use the Service to send spam or unsolicited messages
• Engage in price manipulation or shill bidding

5. Prohibited Items

The following items are strictly prohibited from being listed on nabsta:

• Illegal drugs, controlled substances, and drug paraphernalia
• Weapons, firearms, ammunition, and explosives
• Stolen property or items with removed serial numbers
• Counterfeit goods or items infringing intellectual property
• Adult content, pornography, or sexually explicit material
• Hazardous materials and recalled products
• Live animals (except as permitted by local laws)
• Human remains or body parts
• Items promoting hate, violence, or discrimination
• Personal information or identity documents
• Prescription medications and medical devices
• Alcohol and tobacco products (where prohibited)

We reserve the right to remove any listing and suspend accounts that violate these prohibitions.

6. Listings and Transactions

6.1 Creating Listings

When creating a listing, you agree to:

• Provide accurate descriptions and photos of items
• Set fair and honest prices
• Only list items you have the right to sell
• Respond to inquiries in a timely manner
• Honor the terms of any agreed-upon transaction

6.2 Transactions

nabsta is a platform that connects buyers and sellers. We are not a party to any transaction between users. All transactions are conducted directly between users, and you are solely responsible for:

• Verifying the identity of other users
• Inspecting items before purchase
• Arranging safe meeting locations
• Completing payment and delivery
• Resolving any disputes with other users

7. Fees

nabsta is currently free to use for listing and browsing items. We reserve the right to introduce fees for certain features or services in the future. Any fees will be clearly communicated before they apply.

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, and functionality are owned by nabsta and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

8.2 Your Content

You retain ownership of content you post on nabsta. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY LISTINGS, PRODUCTS, OR SERVICES ADVERTISED BY USERS. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NABSTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless nabsta, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
